Starswiss2013 SA, headquartered at Corso San Gottardo 54/A, 6830 Chiasso (Switzerland), as the Data Controller in accordance with the applicable Italian pro tempore data protection legislation (the “National Legislation”) and EU Regulation 679/2016 – General Data Protection Regulation (“GDPR”) (hereinafter the National Legislation and the GDPR are collectively referred to as the “Applicable Legislation”), recognizes the importance of personal data protection and considers its protection one of the main objectives of its business.

Before disclosing any personal data, Starswiss2013 SA invites you to carefully read this privacy policy (“Privacy Policy”), as it contains important information about the protection of personal data and the security measures taken to ensure its confidentiality in full compliance with the Applicable Legislation. This Privacy Policy also:

  • is intended to be rendered only for the website (“Site”) and does not apply to other websites that may be accessed through external links;
  • shall be construed as a Privacy Policy made pursuant to Art. 13 of Applicable Law to those who interact with the Site;
  • complies with Recommendation no. 2/2001 on minimum requirements for online data collection in the European Union, adopted on May 17, 2001 by the Article 29 Working Party.

Starswiss2013 SA informs you that your personal data will be processed in accordance with the principles of lawfulness, fairness, transparency, purpose limitation and storage, data minimization, accuracy, integrity and confidentiality. Your personal data will therefore be processed in accordance with the legislative provisions of the Applicable Legislation and the confidentiality obligations therein.


In light of the Applicable Legislation, the data controller of the Site is Starswiss2013 SA as more fully defined above.


The term “Personal Data” means any information relating to an identified or identifiable natural person with particular reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more characteristic elements of his or her physical, physiological, mental, economic, cultural or social identity.

The Personal Data collected by the Site are as follows:

a)Navigation Data

The Site’s computer systems collect some Personal Data whose transmission is implicit in the use of Internet communication protocols. This is information that is not collected in order to be associated with the User, but which by its very nature could, through processing and association with data held by third parties, allow the User to be identified. Among these are the IP addresses or domain names of the devices used to connect you to the Site, the URI (Uniform Resource Identifier) notation addresses of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to your operating system and computer environment.

These data are used in order to obtain anonymous statistical information on the use of the Site and to check its correct functioning; to allow – given the architecture of the systems used – the correct provision of the various functions requested by the User, for security reasons and to ascertain responsibility in the event of hypothetical computer crimes to the detriment of the Site or third parties and are deleted after 7 days.

b)Data provided voluntarily

Through the Site, the User has the opportunity to voluntarily provide Personal Data such as name and email address to contact Starswiss2013 SA.

Starswiss2013 SA will process this data in compliance with the Applicable Legislation, assuming that it relates to the User or to third parties who have expressly authorized the User to provide it on the basis of a suitable legal basis that legitimizes the processing of the data in question. With respect to such hypotheses, the User stands as an autonomous data controller, thus assuming upon him/herself all legal obligations and responsibilities. In this sense, you confer on the point the widest indemnity with respect to any dispute, claim, request for compensation for damages from processing, etc. that may be received by Starswiss2013 SA from third parties whose Personal Data has been processed through your use of the Site in violation of Applicable Law.

c)Cookies and related technologies

Starswiss2013 SA collects Personal Data through cookies. More information about the use of cookies and related technologies can be found within the Cookie Policy.


The Personal Data that the User provides through the Site will be processed by Starswiss2013 SA for the following purposes:

  1. Purposes inherent to the execution of a contract to which the User is a party or to the execution of pre-contractual measures taken at your request (e.g.: contact request through the form Write Us”);
  2. purposes of statistical research/analysis on aggregated or anonymous data, without therefore the possibility of identifying the User, aimed at measuring the functioning of the Site, measuring traffic and assessing usability and interest;
  3. purposes related to the fulfillment of a legal obligation to which Starswiss2013 SA is subject;
  4. purposes necessary to establish, exercise or defend a right in court or whenever judicial authorities exercise their jurisdictional functions.

The legal basis for the processing of Personal Data for the purposes referred to in a) is the provision of a service or response to a request that does not require consent under Applicable Law. The purpose referred to in point (b) does not involve the processing of Personal Data, while the purpose referred to in points c) and d) represents legitimate processing of Personal Data within the meaning of the Applicable Legislation since, once Personal Data has been provided, the processing is indeed necessary to fulfill a legal obligation to which Starswiss2013 SA is subject or to exercise its right of defense in court. Providing Personal Data for the purposes listed above is optional, but failure to provide it may make it impossible to respond to a request or fulfill a legal obligation to which Starswiss2013 SA may be subject.


The User’s Personal Data may be shared, for the purposes specified in Section 3, with:

  1. parties necessary for the provision of the services offered by the Site including without limitation the sending of emails and analysis of the operation of the Site who typically act as data processors of Starswiss2013 SA;
  2. persons authorized by Starswiss2013 SA to process Personal Data who have committed to confidentiality or have an appropriate legal obligation of confidentiality; (e.g., employees and contractors of Starswiss2013 SA);
  3. judicial authorities in the exercise of their functions when required by Applicable Law.


Some of the User’s Personal Data are transferred to Recipients who may be located outside the European Economic Area. Starswiss2013 SA ensures that electronic and paper processing of User’s Personal Data by Recipients is done in compliance with Applicable Law. Starswiss2013 SA will process the User’s Personal Data for as long as is strictly necessary to achieve the purposes set forth in Section 3. Notwithstanding the foregoing, Starswiss2013 SA will process the User’s Personal Data for as long as permitted by Italian law to protect its interests (Art. 2946 and 2947(1)(3) c.c.). More information regarding the retention period of Personal Data and the criteria used to determine this period may be requested by writing to the Data Controller.


Within the limits of the Applicable Legislation, you have the right to request from Starswiss2013 SA, at any time, access to your Personal Data, to rectify or erase it or to object to its processing, to restrict its processing as well as to obtain in a structured, commonly used and machine-readable format the data concerning you.

Pursuant to the Applicable Legislation, you have in any case the right to lodge a complaint with the Data Protection Authority if you believe that the processing of your Personal Data is contrary to the Applicable Legislation.


This Privacy Policy is effective as of July 31, 2018.

Starswiss2013 SA reserves the right to modify or update its content, in part or in full, including due to changes in Applicable Law. Starswiss2013 SA undertakes to inform the User of such changes as soon as they are introduced and will be binding as soon as they are posted on the Site. Starswiss2013 SA therefore invites you to visit this section regularly to become aware of the most recent and up-to-date version of the Privacy Policy so that the User is always up-to-date on the data collected and the use made of it by the Data Controller.
